Bike Passenger Arraigned For Alleged Breach Of Peace

A 23-year-old man, Oladele Tosin, was on Friday arraigned before an Ado-Ekiti Chief Magistrates’ Court over alleged breach of peace and attempted stealing.

Tosin, whose address was not given, is facing a four-count charge bordering on breach of peace, cheating, attempted stealing and assault according to the News Agency of Nigeria.

The police prosecutor, Inspector Bamikole Olasunkanmi, told the court that the defendant committed the offence on January 22 between 12pm and 1:30 p.m in Ado-Ekiti.

He alleged that the defendant conducted himself in a manner likely to cause breach of peace by hiring a commercial motorcycle.

Olasunkanmi said he took the motorcyclist to about seven places within Ado-Ekiti and failed to pay him the sum of N3,000 as earlier agreed.

He alleged that the defendant cheated the complainant, who conveyed him to several places in Ado-Ekiti, knowing full well that he had no money to pay for the service rendered.

The prosecutor said the defendant attempted to commit felony to wit stealing on the complainant.

He also alleged that the defendant assaulted the complainant by slapping his face when he demanded his money.

According to him, the offences contravened Sections 181, 338, 416 and punishable under sections 183 and 184 of the Criminal Laws of Ekiti State, 2021.

The prosecutor asked the court for adjournment to enable him to study the case file and present his witnesses.

The defendant, however, pleaded not guilty to the charges preferred against him.

Counsel to the defendant, Mr Adeyinka Opaleke, urged the court to grant his client bail and promised that the defendant would not jump bail.

The Chief Magistrates, Mr Saka Afunso, granted the defendant bail in the sum of N25, 000 with one surety in like sum. He adjourned the case until January 30 for hearing.
