Osun Court Convit Man For Defrauding Investment Company Of Provisions

A Chief Magistrate in Osogbo court ,Osun State has convited a 32-year-Old man, Musibau Muhideen for defrauding Osun State investment Company to the tone of 5m.
Police arraigned Muhideen before Magistrate Mrs Modupe Awodele on June, 6 2017 on two count charge of stealing and fraud which he pleaded not guilty and was granted bail.
The prosecutor Inspector Oladoye Joshua told the court that the accused committed the offense between the month of May and June 2014 at Osun State investment Company limited Orisunbare in Osogbo.
The prosecutor Inspector Joshua said the accused with intent to defraud obtained the company project such as millo, milk, maggi, Nido, tea, coffee and cerealac to the tone of 5m with the pretence to sell same and remit the produce into the company account.
Prosecutor stressed that the accused who was a staff on the company at the time of the incident converted the money into his own use without remitting the money to the company account .
He stated further that the accused stolen 5m belonging to the company.
He submitted that the offence contravene section 516, section 419 punishable under section 390 (6) of the criminal code cap 34 volume 11.laws of Osun State 2003.
Two witness were called to testify against the accused and his statement was also tendered to court and marked as exhibit.
After hearing upon hearing, the Magistrate’s, Mrs Awodele while delivering judgment on Monday convicted Muhideen on count two and pardon him on count one.
The Defense Counsel Barrister Taiwo Awokunle urged the Magistrate’s to be lenient with the convits saying he is a first time offense and a young man who has a long way to go.
The magistrate having listened to the prosecutor remanded the convit in an Ilesha prison custody and thereby adjourned the case to October 29 for sentencing.
