Local Government Election : Court Strikes Out Case Against Aregbesola

Justice Adedoja Ayoola of Osun State High Court in Oshogbo has struck out the suit filed against the Osun State Government over the appointments of the Caretaker Committees   in the (30) thirty local Government in the State.

Barrister Alamo Suliamon who filed the suit against the Governor of the Osun State, House of Assembly of Osun, Attorney General of Osun State and Osun State independent Electoral Commission (OSIEC) in the suit number HOS/67/2017.

Akano alleged that his civil and constitutional right to participate and vote at Local Government election under the constitution of the Federal Republic of Nigeria has been violated when the Governor of Osun State Ogbeni Rauf Aregbesola appointed caretaker Committees for local governments administration, which contrary to the provisions of the 1999 constitution.

The Attorney General and commissioner for Justice of Osun State Dr. Ajibola Basiru led the legal team for first and fourth defendants, argued with plaintiff in the point of law that plaintiff has no legal locus standing.

Dr. Ajibola  further told the court that the suit as presently constituted is wholly incompetent,  the action is academic and hypothetical, the court in the circumstances has no jurisdiction entertain the suit and the claimant has no locus standi.

Justice Ayoola after listening to both counsels’ argument, thereby struck out the case.
