A Chief Magistrate Court sitting in Osogbo, Capital of Osun State on Monday arraigned a 45-year-old Suraju Igbayilola for alleged failure to provide an accused person he stood in for in police station.
Police Prosecutor, Dada Estate Police Station, Osogbo, ASP Fagboyinbo Abiodun told the court that on the 11th of August, 2018, at Ataoja Police Station, in the Osogbo Magistrate District, the accused person stood as surety for one Lukman Sodiq, but failed to produce him on the day he was required to do so at the police station.
The court charge read thus; ” That you Suraju Ignayilola ‘M’ on the 11th day of August, 2018 at Ataoja Police Station Osogbo in the Osogbo Magistrate District did stand as surety for one Lukman Sodiq ‘M’ and failed to him at the police station when required to do so, thereby committed and offense contrary and punishable under section 125 of criminal code Cap 34 Volume II, Laws of Osun State Nigeria 2003.”
The accused person who pleaded not guilty to the offense against him, begged the court to pardon him, as Lukman, who he stood in for absconded before the day he supposed to present him at the police station.
The Defense Counsel Tunde Adedokun prayed the court to grant his client bail in a most liberal term and ready to provide reliable sureties before the court.
The Court Magistrate, O.A Oloyade accepted the bail application with a some of fifty thousand naira, and that the accused person must provide two sureties, in which one of the sureties must reside within the court jurisdiction. She added that the sureties must also provide 3 passport photographs and their current tax clearance must be presented before the court too.
Oloyade however asked the accused person be remanded in police custody till the adjourned date, February 14 when the matter will be presented again in the court.
